Both types of exclusive offers establish the broker and his agents as the client`s only licensed real estate agents. However, these variations differ in that the broker is entitled to a royalty when the property is sold or located by the sole efforts of the client. During an exclusive list, a broker obtains the exclusive right to represent himself: a real estate agent employed by the real estate agent can obtain a listing, but the agent does so while acting on behalf of the broker. The agent does not have the independent right to enter into or enforce the listing contract on his or her behalf.
